Council Tree vs. FCC - To The Supreme Court


Update: Council Tree vs. FCC has filed with the United States Supreme Court to overturn the results of flawed spectrum auctions by the Federal Communications Commission.

From Communications Daily: "For more then four years we sought to undo the Commission's flawed auction rules that undermined two of the largest and most important spectrum auctions in the FCC's history" said George Laub, Council Tree managing director. "While we were gratified with the decision by the Third Circuit Court which found unlawful and vacated key rules at issue, the Court's failure to vacate the auction creates a meaningless victory for petitioners and is a disservice to the public"

Plaintiffs Council Tree Communications, Bethel Native Media and the Minority Media and Telecommunications Council (MMTC) were joined by several public interest groups including Media Alliance and the UCC in questioning the FCC rules governing the 2006 spectrum sales as anti-competitive and overly favorable to the giant corporations that dominate the market.

 The suit sought to compel rule changes for future auction sales to assist new entrants into the market. The rule changes are anticipated to benefit small business and minority-owned media companies to participate.
